업비트 '일부 영업정지 3개월'...가상자산 업계 '당혹'

금융위원회 금융정보분석원(FIU)이 25일 가상자산 거래소 업비트에 일부 영업정지 3개월을 통보했다. 이에 따라 신규 거래소 이용자 가상자산 이전이 3개월 정지된다.

이와 함께 FIU는 이석우 두나무 대표에 대한 문책 경고 및 준법감시인 면직 등 두나무 직원 9명에 대한 신분제재 조치도 통보했다.

업비트는 지난해 고객확인의무(KYC) 위반, 거래금지 의무 위반, 의심거래 보고의무 위반 등 혐의로 FIU 조사를 받아온 바 있다.

FIU는 업비트 사업자 신고 갱신 심사를 두고 현장 조사를 진행하는 과정에서 업비트가 KYC 절차를 제대로 수행하지 않은 사례를 발견했다. 해당 사례에는 고객의 신분증에서 이름이나 주민번호가 명확하게 식별되지 않았음에도 계좌 개설이 승인된 사례가 포함됐으며 FIU는 이를 자금세탁방지(AML) 의무 위반으로 판단했다.

이번 FIU의 결정에 대해 가상자산 업계는 당혹스러움을 감추지 못하는 분위기다. FIU의 이번 조치가 향후 국내 가상자산 거래소 전반에 걸쳐 강도 높은 규제를 적용할 가능성이 있는 것으로 받아들이는 모습이다.

한 업계 관계자는 "국내 1위 거래소인 업비트가 제재를 받았다는 사실에 시장이 큰 충격을 받았다. 추후 다른 거래소에 대한 제재 가능성도 생긴 셈이다"라며 "금융당국이 가상자산 산업에 대한 규제 강도를 한층 높이려는 기조를 드러낸 것으로 해석된다"이라고 말했다.

또 다른 관계자는 "자금세탁방지 의무 강화는 필요하지만 국내 가상자산 산업의 경쟁력을 저하시킬 수 있는 규제로 발전할 가능성에 대한 우려는 있다"라고 말했다.

이어서 "규제 방향이 산업 발전을 저해하지 않는 선에서 조율될 필요가 있다"고 지적했다.
