할로자임, 키트루다 피하주사제형 특허 소송

할로자임(Halyzyme)이 미국 뉴저지 연방 법원에 머크의 항암제 키트루다의 피하 제형이 15개 특허를 침해했다며 소송을 제기했다.

할로자임 측은 머크의 키트루다 피하제형(SC) 출시를 막기 위한 목적으로 소송을 제기한 것으로 알려졌다. 키트루다SC는 오는 9월 이전에 미국 식품의약국(FDA)으로부터 허가를 받을 것으로 전망된다. 머크는 미 FDA 승인 이후 연내 제품을 출시한다는 계획이다.

할로자임은 가중적 손해배상(enhancement of damages)도 주장하고 있다. 머크가 자사의 저작권을 침해하고 있고, 그 혐의가 ‘고의적’이라는 것. 관련해 미국 특허법은 고의 침해가 인정될 시 배상을 명령할 수 있다는 점을 이용한 것이다.

앞서 할로자임은 잠재적인 라이선스 계약을 위해 머크와 접촉, 합의에 이르지 못하면 소송이 이어질 수 있다고 밝힌 바 있다. 이후 실제로 소송을 제기한 것. 관련해 머크는 키트루다SC 제조를 위해 알테오젠의 베라히알루로니다아제 알파나 ATL-B4라는 히알루로니다아제를 사용하고 있다.

할로자임은 알테오젠의 ATL-B4는 자사 라이브러리에 없지만 알테오젠 제품에 사용된 많은 아미노산 변형이 실제로 자사 특허에 포함돼 있다며 맞서고 있다.
