공정위, 푸라닭·60계치킨에 시정명령…"가맹점에 강제구매"

공정거래위원회는 치킨 프랜차이즈 본사들이 가맹점주에게 일부 품목을 본사에서만 구매하도록 강제한 행위에 대해 시정명령을 내렸다고 30일 밝혔다. 

공정위에 따르면 ‘푸라닭’을 운영하는 아이더스에프앤비는 지난 2018년 7월부터 2024년 2월까지 ▲영수증 인쇄용 포스용지 ▲치킨 박스 봉인용 보안스티커 ▲식자재 라벨스티커 등을 본사에서만 구매하도록 했다. 해당 계약서에는 이를 위반할 경우 상품 공급을 중단하거나 전월 매출의 5%에 해당하는 위약금을 부과할 수 있다는 조항이 포함돼 있었다.

‘60계치킨’을 운영하는 장스푸드도 2022년 11월부터 2024년 7월까지 매장 유리에 부착하는 홍보용 라이트패널을 가맹점주가 시중이 아닌 본사에서만 구매하도록 했다. 이 역시 이를 어길 경우 물품 공급 중단이나 가맹계약 해지를 할 수 있다는 내용이 계약서에 명시돼 있었다.

공정위는 이들 품목이 치킨의 맛이나 품질 유지와 직접적인 관련이 없는 점을 들어, 본사를 통한 구매를 강제한 행위는 부당하다고 판단했다. 특히 실제로 불이익을 가하지 않았더라도, 계약서에 해당 조항을 명시하고 위반 시 제재가 가능하도록 한 것만으로도 ‘강제성’이 있다고 판단했다.

공정위는 가맹본부가 ▲세제 ▲주방설비 ▲포장용기 ▲주방집기 등 필수적이지 않은 물품에 대해 특정 거래처에서만 구매하도록 강제한 과거 사례를 함께 제시하며, 이번 조치가 가맹점주의 선택권 보장과 거래 관행의 투명성 제고 차원에서 이뤄졌다고 설명했다.

공정위는 향후에도 구입강제품목과 관련한 불공정거래행위를 지속 점검하고, 가맹계약서 내 관련 내용의 명시 의무화 및 거래조건 변경 시 가맹점주와의 협의 의무 제도를 통해 공정한 유통질서를 확립해 나가겠다는 방침이다.

푸라닭을 운영하는 아이더스에프앤비는 이날 입장문을 내고 “공정위에서 발표한 부당필수품목 지정행위 등과 관련해 현재 푸라닭 치킨은 해당 품목들을 필수품목으로 지정하고 있지 않음을 밝힌다”며 “향후에도 가맹사업법 위반 관련 문제나 오해가 생기지 않도록 최선의 노력을 다하겠다”고 밝혔다.
