식당‧숙박시설서 장애인 보조견 출입 거부 빈번

식당과 숙박시설에서 장애인 보조견 출입이 거부되는 사례가 여전히 존재하는 것으로 나타났다.

최근 보조견을 동반한 청각장애인이 식당 출입을 거부당하는 사건이 사회적 공분이 일었다. 

서미화 더불어민주당 의원이 보건복지부로부터 제출받은 자료에 따르면, 2020년~2025년(5월) 장애인복지법 위반으로 과태료 처분을 받은 건수는 ▲부산 4건 ▲충남 4건 ▲서울 3건 ▲경기 2건 ▲강원·대구·대전·인천·전남 각각 1건 등 총 18건으로 나타났다.

시각장애인 보조견 출입 거부가 11건으로 가장 많았다. 이어 ▲청각장애인 보조견 6건 ▲뇌전증 장애인 보조견 1건 등이 뒤를 이었다. 출입이 거부된 장소는 ▲식품접객업소 13건 ▲숙박시설 3건 ▲대형마트 1건 ▲대중교통 1건 등이었다.

현행 ‘장애인복지법’ 제40조 제3항은 보조견표지를 붙인 장애인 보조견의 경우, 대중교통이나 공공장소, 숙박시설, 식품접객업소 등에 동반 출입을 거부해서는 안 된다고 명시하고 있다. 이를 정당한 사유 없이 거부할 시 과태료를 부과하도록 규정하고 있다.

서미화 의원은 “장애인 보조견은 장애인의 일상과 안전을 책임지는 필수 동반자”라며 “법률에 명시된 권리가 현장에서 제대로 지켜지지 않는다면 정부 차원의 더 철저한 관리·감독과 홍보, 교육이 필요하다”라고 밝혔다.
